1. What Pelican Bid does
Pelican Bid helps you respond to RFPs, grants, and questionnaires. You upload a request and your supporting materials; we use AI to break the request into questions, evaluate fit, and draft and score answers you can edit and export. Pelican Bid is a drafting and productivity tool — it is not a law firm, consultant, or professional advisor, and using it does not create any professional relationship.
2. Eligibility and accounts
You must be at least 18 and able to form a binding contract. If you use Pelican Bid on behalf of an organization, you represent that you are authorized to bind it to these terms. You’re responsible for activity under your account and for keeping your login credentials secure. Accounts are handled by our authentication provider.
3. Beta service
Pelican Bid is currently offered in beta. During beta the service is free, and features, pricing, and availability may change or be discontinued. Prices shown are the intended launch prices and are subject to change before launch. We may set reasonable usage limits to keep the service available for everyone.
4. Your content
You keep all rights to the documents and materials you upload and the responses you create (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to provide the service to you — including sending relevant portions to the AI providers described in our Privacy Policy to generate and score your drafts. You represent that you have the right to upload Your Content and that doing so doesn’t violate any law, contract, confidentiality obligation, or third-party right. Do not upload classified material or information you’re not permitted to share.
5. AI output — read this
- Answers are generated by AI and may be inaccurate, incomplete, or out of date. You are responsible for reviewing, verifying, and editing every answer before you rely on or submit it.
- Pelican Bid does not guarantee that a response will be compliant, responsive, or successful, and makes no promise that you will win, place, or be shortlisted for any award.
- You are solely responsible for meeting the requirements, format, certifications, and deadlines of any request you respond to, and for the final content you submit.
- Pelican Bid does not provide legal, financial, tax, or other professional advice. Consult a qualified professional where you need one.
6. Acceptable use
You agree not to:
- use the service for anything unlawful, infringing, or deceptive;
- upload content you don’t have the right to share, or that contains malware;
- attempt to breach security, access other users’ data, or probe the service without authorization;
- reverse engineer, scrape, or resell the service, or use it to build a competing product;
- overload or interfere with the service, or bypass usage limits or rate limits.
7. Payment
The service is free during beta. When paid plans launch, applicable fees, billing terms, and refund policies will be presented before you purchase. Pricing is per response, with no subscription, as described on our Pricing page.
8. Our intellectual property
The Pelican Bid software, design, and brand are owned by us and protected by law. These terms don’t grant you any right to our name, logos, or technology except the right to use the service as intended. This does not affect your ownership of Your Content.
9. Third-party services
The service depends on third parties (for example AI, hosting, authentication, and email providers). We’re not responsible for their acts or omissions, and their availability can affect the service.
10. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding accuracy, reliability, or results. We don’t warrant that the service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the fullest extent permitted by law, Pelican Bid and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, goodwill, or a lost or unsuccessful bid, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us for the service in the three months before the claim, or US$100.
12. Indemnification
You agree to indemnify and hold Pelican Bid harmless from claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the service, or your breach of these terms.
13. Termination
You may stop using the service at any time. We may suspend or terminate access if you violate these terms or to protect the service or other users. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, indemnity) will survive.
14. Changes to these terms
We may update these terms as the product evolves. When we make material changes, we’ll update the “last updated” date and, where appropriate, provide additional notice. Continuing to use the service after changes take effect means you accept them.
15. Governing law
These terms are governed by the laws of the United States, without regard to conflict-of-laws rules. The courts located there will have exclusive jurisdiction over disputes, except where applicable law provides otherwise.
